Hello Friends,
In January I filed i765 (17 month extension) and I received the 797C notice which had a typographical error (Birth date error caused by USCIS), so I informed USCIS and got that corrected. I received a letter stating that the birth date has been corrected but eventually, when I received the approved EAD card, the error was still there. Then, I reapplied the i765 form with all the necessary docs and the original EAD card, but somehow, it got lost. I applied the whole application set again but this time with the photocopy of the EAD card, the error proofs and a cover letter but no check/money order.
It's been 1 month and I have not received any updates on my case. I called USCIS and they don't have any updates on the case. Do you think USCIS can cause a problem in approving my application and can I still work while my application is still pending.

Hello,
I am holding a valid H1-B visa which was stamped in 2007. But before i could make my travel plan i could see recession hitting US and people out of jobs. This made me to hold back my job at home instead of quitting in a hurry.
Now i am based in UK on an assignment and i would like to VISIT USA as a TOURIST for 4 weeks to see my brother.
1) Am i allowed to visit as a visitor ?
2) Can i still hold H1-b visa active without being cancelled ?
Anybody, please could you advise me how to go about.

I am on H1 (primary), currently working for this company for past 6-7 years. Applied for I-485, AP, EAD on 2nd July along with my husband's petition, who came to US on H4. Changed to F1 for past 5 years. He just got his EAD card and in next 6 months time, he will be accepting position with my same company upon graduation.
My question is what shd we do now, since he is on F1 on student records, but has a EAD approved.
Possibilities :-
1) Shd he call his student dept and get records changed from F1 to EAD holder?
2) Shd he continue as F1 and not worry about EAD for now?
3) Shd he accept the pjob offer on EAD and move on from there?
4) Can I continue to be on H1 and not use up EAD for now?
Pls. advise me our further course of action, which is legally correct.

Biometrics are not required for AP. You can paper file or efile - it is the same in the case of AP.
My wife paper-filed her EAD and didn't have to do Biometrics.
Will she have to do her Biometrics when she paper-files or e-files her AP?
Anybody has any experience ?

Are you employed by a US firm. My only concern is that if you apply from indian and are out of US for an extended period of time, USCIS may assume that you have abandoned your immigration intent.

Still an agent came from USCIS last week for site inspection. He talked to HR first, then came to my room. ASked for an photo id, then asked usual questions, job responsibilities, salary, location,
educational qualifications, salary statement...
took some fotos of my room and desk b4 he left.
Everything went on for 15 mints.
Thought, I should share this info with you.

Hello Everyone great community here and very useful information.
Received the email from Cris I-140 approved today.
I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)

Reid Eyes Rules Changes To Restrict Amendments (http://www.rollcall.com/issues/53_10/news/19488-1.html) By Emily Pierce, ROLL CALL STAFF, July 23, 2007
After nearly seven months of battling Republican filibusters and controversial amendments on the Senate floor, Majority Leader Harry Reid (D-Nev.) said Friday he may seek to change Senate rules to make it easier to restrict amendments on the floor.
Reid said Rules and Administration Chairwoman Dianne Feinstein (D-Calif.) would be tasked with exploring what rules changes should be made.
Noting that there has been a "growing breakdown between the majority and minority in terms of how to get things done," Howard Gantman, Feinstein's chief of staff for the Rules panel, said the committee would conduct a "comprehensive review" and look at the rules on the germaneness of amendments and how long Senators have to review proposals before voting on them.
"Sen. Feinstein is very serious about looking at the vast range of amendments that are brought in at the last minute that are not germane," said Gantman. He added that the panel's focus would be on "how to better get things done."
Reid spokesman Jim Manley cautioned that Reid "has no intention of unilaterally seeking a rules change."
However, Minority Leader Mitch McConnell (R-Ky.) scoffed at the notion of limiting or restricting Senators' ability to offer amendments, which he likened to freedom of speech.
"Look, nobody's going to shut anybody up in the Senate," he said at a press conference Friday. "There's going to be robust debate. You can just write that down. And I understand Sen. Reid's frustrations, but we're not going to establish any speech police in the Senate - not now, not ever."
Reid apparently reached his boiling point Thursday night when Republicans used Senate budget rules to offer a number of non-germane amendments to a student loan financing bill.
"What went on last night was ridiculous," Reid said on the Senate floor. "We should change those rules. ... We will have to take a look at that."
Reid said Health, Education, Labor and Pensions Chairman Edward Kennedy (D-Mass.) and ranking member Mike Enzi (R-Wyo.) managed the student loan measure "very well until it ran into the rule that we have here that allows unending amendments on any subject forever, literally, before you get to final passage."
Because the higher education bill - by virtue of its status as a budget reconciliation measure - was immune to filibuster, Senate rules permitted unlimited amendments to be offered and voted on. On Thursday night, in particular, Senators were given only a few minutes to review the substance of some amendments before they were asked to vote on them.
As is customary with budget and reconciliation measures, Senators engaged in a long series of back-to-back votes, known as a "vote-a-rama," at the end of the debate. But Democrats said Republicans' insistence on having 14 non-germane votes - including six related to cutting taxes, three related to immigration and two related to terrorism - was excessive.
When Democrats pushed back with their own non-germane amendment expressing the Senate's opinion that President Bush should not pardon Vice President Cheney's former chief of staff, Scooter Libby, Republicans tried to force a vote on former President Bill Clinton's controversial pardons.
But before the Senate could vote on that, Reid asked that both the Libby vote and the GOP pardons amendment be stricken from the Congressional Record, and the chamber voted on final passage of the bill.
Manley explained: "These so-called vote-a-ramas are bad for the system, and they may lead to bad policy. As have leaders in the past, all Sen. Reid was doing was expressing his frustration at the Republicans' desire to score cheap political points at the expense of a good-faith effort to pass a bill that will make college education more affordable for more Americans."

Even though America's Jewish community includes virtually known of the folks being targeted by the anti-immigrant law in Arizona, members of the community get nervous when they see individuals in another minority group being targeted unjustly. Laws that demand that people show their papers make Jews especially concerned since in generations past (think Nazi Germany) in other countries, similar laws were part of campaigns of persecution. Hi,
I have an EB2 I-140 approved with priority date of July 2006, but also recently got EB3 I-140 approved with priority date of May 2003.
Even though the dates are current, but it may retrograte in coming months, so Can I file I-485 using my approved EB2 with the priority date of EB3.
Please advice.
